Dangerous Intersections and New York City Roads

According to the New York City Police Department, 108,211 traffic accidents occurred in the city in one recent year. That’s almost 300 crashes per day and 12 every hour. The following intersections and roads are frequent sites of accidents in New York City and the surrounding area:

There are many reasons why intersections lead to dangerous accidents in New York City, including the following:

  • Congestion – With too many vehicles crammed into one intersection, all it takes is one driver making a small mistake to cause a severe accident. There is very little room for error.
  • Pedestrians, bicycles, and cars – Because of traffic congestion, many New Yorkers opt to walk or bike instead. That means drivers who don’t watch out can seriously injure crossing pedestrians and bicyclists, in addition to other drivers.
  • Distracted drivers – Drivers sitting in traffic or at an intersection may respond to text messages, check their email, or otherwise engage in distractions. When a driver is distracted, even for a moment, they can cause an accident.
  • Road rage – Standstill traffic can be frustrating and maddening. With tempers flaring, angry drivers make aggressive moves that endanger other road users.
  • Lack of traffic signals – When drivers approach an intersection with an inoperable traffic light, they may be tempted to make dangerous maneuvers to navigate the intersection.
  • Failure to yield – While traffic signals control many of the intersections in New York City, standard rules about yielding the right-of-way still apply. For example, drivers turning at an intersection should yield to through traffic. Failing to yield is a common cause of accidents.
  • Poor intersection design – Some intersections were not designed to accommodate the amount of traffic in New York City. If these intersections are not redesigned to address flaws, they will remain dangerous for drivers.
  • Maintenance issues – New York City is notorious for ongoing construction and also has many poorly maintained roadways. Incomplete or delayed maintenance increases the likelihood of an accident.

Common Injuries Caused by New York Intersection Accidents

Various injuries can result from intersection accidents, and they are often severe. Some of the most common injuries caused by New York intersection crashes include:

How Fault Is Determined for Intersection Car Crashes in New York

New York is one of a dozen states that follow a no-fault car insurance system. Drivers must maintain personal injury protection (PIP) coverage as part of their auto insurance policy. If a New Yorker driver or passenger gets in an accident, they file a claim with the insurance provider for the vehicle they were in within 30 days, regardless of who was at fault for the accident. If a pedestrian is injured in an accident, they file a no-fault claim with the insurance carrier of the vehicle that hit them.

There are circumstances when a car accident victim in New York can step outside the no-fault insurance system and seek compensation for pain and suffering by filing a third-party claim against the at-fault driver’s insurance provider or a personal injury lawsuit against the other driver.

To do so, the accident victim must suffer a “serious injury,” which New York law defines as:

  • Wrongful death
  • Dismemberment
  • Significant disfigurement
  • Fracture
  • Loss of a fetus
  • Permanent loss of use of a body organ, member, function, or system
  • Permanent consequential limitation of a body organ or member
  • Significant restriction of use of a body function or system
  • Non-permanent disability that prevents victims from substantially performing all of their usual activities for at least 90 out of the first 180 days after the accident

Potential Compensation for Injuries in NYC Collisions

The amount of compensation you can seek will depend on the circumstances of the accident, the severity of your injuries, and the type of claim you pursue.

If you file a claim with an insurance provider for personal injury protection (PIP) or no-fault coverage, you can recover compensation for the following:

  • Medical bills for “reasonable and necessary” care
  • Up to 80 percent of lost wages, up to $2,000 per month for up to three years after the accident
  • Up to $25 per day for “reasonable and necessary” expenses related to the accident, such as transportation to medical appointments and household assistance
