New York Helicopter Accident Lawyers

Seasoned New York City Personal Injury Attorneys

Helicopters are far more dangerous than commercial aircraft. Fatality statistics show the risks associated with helicopter rides — in 2012 alone, 174 people died in 83 civilian helicopter accidents. Some of these incidents occurred on charter flights while others happened on medical helicopters or helicopters run by tourist operations.

When a helicopter accident occurs, victims of the collision may be able to file a lawsuit to recover compensation from those responsible for the tragedy. Unfortunately, helicopter accidents frequently result in fatalities. Surviving family members of people who died in crashes can pursue a wrongful death claim to recover both for the loss of their loved one’s companionship as well as for economic losses.

While these cases can be complex, The Perecman Firm, P.L.L.C., has the legal background and knowledge to help. Call our New York City personal injury lawyers today for a free consultation.

New York Helicopter Regulations

Helicopters are regulated by the Federal Aviation Administration, which issued a new final rule in 2014 that imposed stricter requirements on helicopter operators, including air ambulances. The FAA’s rule was prompted, in part, by the fact that the job of an EMS helicopter pilot ranked as the most dangerous career in America in 2008. In just that year alone, 12 air ambulances crashed and killed 29 crew members and patients.

Under the FAA’s new rules, helicopter operators must:

  • Comply with stricter flight regulations and procedures
  • Improve communications
  • Undergo additional training
  • Fly with additional on-board safety equipment
  • Use enhanced procedures for when they are flying in bad weather, at night, or when landing in a remote location
  • Incorporate the latest on-board technology and equipment within three years
  • Equip aircraft with flight data monitoring systems within
  • Some helicopters, including air ambulances, must have additional equipment

These new regulations impose more safety rules in an effort to protect passengers. It is the job of the helicopter operator and pilot to ensure that the risk of a collision for all parties involved. The operator, aircraft owner, or parts manufacturer can all be held legally liable if a crash occurs due to their negligence or violations.
