Do I Need a Lawyer After a Long Island Car Accident?

If you suffered any injuries, even seemingly minor ones, or other losses, it is likely in your best interest to hire an attorney.

New York law requires all drivers to carry Personal Injury Protection (PIP) insurance, which covers medical expenses and lost wages resulting from a car accident up to the policy’s limit. The policyholder is covered regardless of who is at fault for the crash, which is why PIP is called “no-fault” insurance. Drivers and passengers are covered by the policy of the vehicle they are in at the time of the accident. Pedestrians are covered by the policy of the vehicle that struck them. An application for PIP benefits must be filed within 30 days of the accident. However, PIP insurance does not provide compensation for pain and suffering, and emotional distress.

A Long Island car accident victim may be able to step outside of the no-fault system to seek compensation for pain and suffering and other financial losses under certain circumstances.

You should contact our experienced car accident attorneys if you believe any of the following apply to your situation:

  • Your medical bills, lost wages, and related expenses exceed the coverage provided by your PIP policy.
  • You suffered a “serious injury” as defined under New York law, including a fracture, death, dismemberment, significant disfigurement, permanent loss of use of a body organ, member, function, or system, permanent consequential limitation of a body organ or member, significant restriction of use of a body function or system, or a non-permanent disability that prevents victims from substantially performing all of their usual activities for at least 90 out of the first 180 days after the accident.
  • You have suffered personal losses from the accident, such as pain and suffering or emotional distress.

Recoverable Compensation You Could Seek After a Long Island Car Accident

If you are eligible to file a personal injury lawsuit, you could be entitled to seek compensation for the following financial and personal losses:

  • Medical bills
  • Lost wages
  • Loss of future earning capacity
  • Reduced quality of life
  • Pain and suffering
  • Emotional distress
