What is the Difference Between FELA & Workers’ Comp?
While it can be likened to state workers’ compensation, FELA has several differences. For example, FELA does not pay out compensation according to a set benefits schedule. Pain and suffering, which is not covered under state workers’ compensation systems, is granted under FELA as well as economic damages such as medical expenses and lost wages.
Proving Negligence in a FELA Claim
Compensation from FELA is not automatic. Monetary payouts are decided by juries on a comparative negligence basis upon proof of full or partial negligence by railroad company officers, agents, or other employees or due to defects.
Once negligence is proven, what amounts to full compensation may be awarded to the railroad worker or his / her personal representative. Often, this compensation is far more than other workers would receive through workers’ compensation benefits programs.
Why Hire an Attorney for Your FELA Claim?
Since the 1960s and forward, tens of millions of dollars have been awarded to railroad workers in lawsuits under FELA involving injuries and deaths related to negligence. It has been estimated that thousands of workers were exposed to high concentrations of these toxic substances for years at a time which is linked to toxic encephalopathy (brain damage).
Documenting your injuries and proving liability in your FELA case can be a complicated and time-consuming matter. While being forced to deal with the consequences of your injuries or work-related disease, you will likely have little time or attention for a complex legal task. An experienced New York City FELA attorney at our firm can handle all of the details of your case.
