The fall occurred during the dismantling of pipe scaffolding when an aluminum plank shifted and lifted unexpectedly, causing him to lose his balance and fall to the level below.
The lawsuit alleged violations of New York Labor Law §240(1), which requires proper protection against elevation-related hazards. The scaffold planking was not adequately secured, and no fall protection system was in place during the dismantling process.
The case resolved for $4.3 million following litigation led by Zach Perecman and Adam Hurwitz. The recovery provided substantial compensation for the worker’s medical treatment and long-term impact of his injuries.
