The wrongful death lawsuit alleged violations of New York Labor Law §240(1), commonly known as the Scaffold Law, which requires proper fall protection for workers exposed to elevation-related hazards. The case centered on the failure to provide adequate safety devices to protect against the risk of a catastrophic fall at a major NYC construction site.
The case resolved for $29 million following litigation led by Adam Hurwitz and Steven Dorfman, under the direction of the firm’s founder, David Perecman.
