Wrong-Way Driving Accidents
Were You Seriously Injured By A Negligent Driver?
Changes to seatbelt laws and law enforcement crackdowns on driving under the influence (DUIs) have helped push the number of people who are killed in motor vehicle accidents down by almost 25 percent over the past decade according to data released by the United States Department of Transportation’s National Highway Traffic Safety Administration (NHTSA). Unfortunately, this decrease hasn’t affected the number of people killed in wrong-way driving accidents – according to NHTSA figures, about 360 people die in these types of crashes every year. Even though wrong-way accident fatalities only make up a fraction of the more than 32,000 people who were killed in motor vehicle accidents in 2014, these types of crashes are almost always caused by the negligence or wrongdoing of the wrong-way driver.
If you or someone you love was seriously injured or killed in an accident caused by a driver traveling the wrong way on the road, contact The Perecman Firm to discuss your potential case and put together a plan of action that best suits your situation. You should not be required to shoulder the financial burden that builds up through medical bills and other damages, and we have spent decades representing injured victims throughout New York in order to secure the compensation our clients require in their time of need, and have successfully recovered more than half a billion in verdicts and settlements since we first opened our doors.
What Causes These Types of Accidents?
The National Transportation Safety Board (NTSB) has been keeping a close eye on what causes wrong-way driving crashes, and released a Highway Special Investigation Report (PDF) back in December of 2012 that details some of their findings. One of the more telling pieces of information they revealed what that a large percentage of these crashes took place after the at-fault driver entered an exit ramp – while the official investigators identified poor signage and confusing roadway design as a factor in a number of these crashes, the blame frequently fell on the drivers themselves.
Some of the most notable influencing factors included in the report were:
- Age: Drivers above the age of 70 made up nearly 15 percent of all wrong-way driving accidents, even though the same age group is only involved in about 3 percent of right-way driving accidents. According to the information released in the NTSB report, 233 drivers older than 70 were the at-fault driver in a wrong-way crash, while only 51 drivers in that age group were driving the correct direction in these types of crashes.
- Alcohol: The NTSB report showed that DUIs was the single most common factor involved in wrong-way driving accidents. According to the data, the Blood Alcohol Content (BAC) of 69 percent of at-fault drivers in these types of crashes was 0.08 percent or above, and 59 percent of them had a BAC level at or greater than 0.15 percent. Even with these staggeringly large figures, officials believe that it may be even higher given the BAC level information missing from many of these crashes.
- Nights and Weekends: 78 percent of wrong-way crashes happened at night, and approximately one third took place somewhere between midnight and 3 a.m. The NTSB also reported that more than half – around 57 percent – of these types of crashes occurred on Fridays, Saturdays and Sundays.
