New York’s Dram Shop Act

New York General Obligations Law 11-101, also known as the Dram Shop Act, states that an establishment can be held liable if it sells alcohol to anyone under the age of 21, a visibly intoxicated person, or a known habitual drunkard, who then cause an injury or damage to a person, property, means of support, or otherwise.

Similar to the Dram Shop Act is New York General Obligations Law 11-100. It states that anyone who knowingly assists an underage person in getting drunk can be held liable if that person then causes injury or damage to a person, property, means of support, or otherwise while intoxicated.
