Founding Partner David Perecman and Steven Dorfman of The Perecman Firm, P.L.L.C. legal team recently secured a 12 million dollar settlement on behalf of a client who was seriously injured while working on a construction site. The case was resolved less than two years after the accident occurred.
The multi-million dollar settlement arose from an incident that took place in September 2016. Our client, a driver in the Teamsters union, had been working on a demolition site in lower Manhattan hauling debris. While performing job-related duties, he was struck by a piece of angle iron and fell roughly 15 feet from a ladder which had been attached to the side of a roll-away container being used to hold debris. Our client suffered a number of injuries (including a brain injury, and injures to his hand and shoulder blade), and underwent multiple surgeries.
After the incident, David, Steven, and our legal team worked to investigate the circumstances. Though there were no witnesses, it is believed that as an excavator was being used to dump debris into the container, a large piece of angle iron sprung up and struck our client, causing his fall.
Our firm filed suit against the defendants, claiming violations of New York Labor Law §§ 200, 240(1), and 241(6), based on violations of the New York State Industrial Code. It was alleged the defendants:
- Failed to provide our client with adequate safety devices, including ladders and other equipment, which would have allowed him to safely perform his work at the container’s elevated height; and
- Allowed the plaintiff to remain in the area of the container while the excavator was in use performing work connected with the demolition.
Defendants responded to the claims by arguing that our client was not performing any demolition work at the time of the accident and was, therefore, not protected under any sections of the Labor Law. Additionally, defendants claimed our client had received explicit instructions to not climb the ladder and was a disobedient worker.
By utilizing our experience along with evidence accumulated from independent investigations, David Perecman and our team ultimately negotiated a mediated settlement totaling $12,000,000, in addition to a waiver of a workers’ comp lien totaling more than $2 million.
