Car Accident Sends SUV into Construction Site

Car Accident Sends SUV into Construction Site

Sport utility vehicle sails into subway work site and falls partially into hole

As if construction workers did not have enough hazards to contend with, an SUV crashed into a Second Avenue subway construction site and landed halfway into a hole. According to the New York Daily News (7.30.13), a Toyota SUV ran a red light and collided with a Honda CR-V. The impact sent the CR-V sailing into the construction site, and head-first into the hole.

The CR-V driver suffered minor injuries in the auto accident.

Construction workers have always dealt with a challenging mix of traditional hazards mixed with the new. Besides age-old threats of falling objects, electricity, and working at heights on scaffolds and ladders, workers must also be concerned about unforeseen and surprise dangers, like out-of-control cars.

Workers’ compensation is for construction workers who are injured on the job

The New York workers’ compensation benefits program was designed to help workers who have suffered an injury in a workplace accident. Workers’ compensation enables them to quickly obtain the money for necessities including medical expenses, lost wages, and full or partial disability benefits.

In the case of death, workers’ compensation provides survivor benefits to the dependents.

In New York, workers’ comp is no-fault insurance, so a worker is covered even when the accident is his or her fault.

Construction accident lawyers and workers’ compensation claims

In addition to New York workers’ compensation, workers who are injured on the job may also be able to pursue additional compensation through a third-party claim, when permitted by the facts of the case. Third-party claims usually exceed the value of workers’ comp benefits and have no financial limits. They can be filed against owners, contractors, subcontractors, and other negligent parties, with the exception of the injured worker’s employer.

A workers’ compensation lawyer familiar with New York law can evaluate a worker’s case to determine if third-party injury compensation, in addition to workers’ compensation benefits, is a possibility. A New York workers’ compensation lawyer can aggressively fight to protect the legal rights of an injured worker or the worker’s family, helping them to collect the benefits they deserve after a workplace accident.
