Brake Malfunction Probable Cause of Auto Accident That Killed 15-Year-Old Girl

A brake malfunction is being blamed for the auto accident that killed Kalie Gill, 15, at a church festival in Westchester County, N.Y., reported USA Today (1.30.14).

Kalie was killed and her 12-year-old sister seriously injured when they were hit by a 2002 Jeep as they were leaving the carnival on October 11.

The car that hit them” lurched forward from its parking lot spot and plowed through the intersection,” said USA Today. It hit a number of other vehicles before jumping a curb and hitting the two girls while they were on the sidewalk.

The vehicular accident occurred during an annual Octoberfest.

Reportedly, an investigation of the auto accident found that the brakes on the SUV had malfunctioned. The finding may be important in any potential civil case related to the incident.

Auto accident injuries and fatalities caused by brake failure

Auto accidents are not always the driver’s fault. Car accident injuries and death can occur for a variety of reasons, including vehicle defects such as faulty brakes, tires and other equipment. The brake system of a vehicle is critical for safety on the road. Brake failures, unfortunately, often go unnoticed until an accident occurs.

If a brake failure or other mechanical failure contributed to an accident, the auto manufacturer may be liable for all damages resulting from the accident, including medical expenses, lost wages, and pain and suffering.

Brake failure may also be evidence of a driver’s negligence. For example, if a driver knowingly drove the car in a dangerous condition, this would be considered driver negligence. Drivers are responsible for resolving any issues with their car before taking it on the road. If a driver is determined to have been negligent, he or she may be liable for damages.

It’s also possible that a mechanic who worked on the car left the brakes in a faulty condition. If this is the case, the mechanic could be liable for any damages resulting from the accident.

Signs of brake failure include difficulty stopping, unusual noises coming from brakes, pulling to one side, low brake pedal pressure and brake pedal vibration.
