Just three weeks after the New York wrongful death lawyers representing Esmin Green’s family settled their civil case against Kings County Hospital, the New York City Department of Investigation released a report describing steps several hospital staff took to cover up the incident, the Daily News reports.
The report details the actions of several nurses and doctors who falsified records to make it seem as if they gave Ms. Green more attentive care than they did. Nurses made false entries in progress notes and an observation sheet while two hospital doctors falsified medical records to indicate they had examined Ms. Green when they had not.
Surveillance video showed that Ms. Green received essentially no care for 24 hours after being admitted to the hospital. Only after she had collapsed and lay on the floor for about an hour did she receive any care from the hospital staff.
This video was crucial in determining that something was amiss with Ms. Green’s unfortunate visit to Kings County Hospital. It also served as the bulk of the evidence in the DOI’s investigation.
When the DOI questioned the personnel involved in the cover-up, one nurse confessed to falsifying records while one other nurse and the two doctors took the Fifth.
The report will be sent to Brooklyn’s district attorney, Charles Hynes, “for whatever action [he] deems appropriate.” Ms. Green’s family hopes he decides to prosecute those involved.
As Green’s daughter, Tecia Harrison, told the News, “Those who are guilty should be prosecuted and sent to jail. That’s more important than the settlement.”
