Understanding Who Is Responsible for Sidewalk Upkeep
Many people would refer to any sidewalk alongside a street in New York City as a "city sidewalk." However, due to a law that the City Council passed in 2003, the city itself is no longer always responsible for injuries caused by sidewalk defects and lack of proper snow and ice removal on many sidewalks.
Under this law, the owners of most types of private property are liable for compensating the victims of falls that happen on sidewalks alongside their properties. Residential buildings housing one to three families that in whole or in part are owner-occupied for residential purposes are exempt from the law.
Did the City Have Notice of a Defect Before Your Accident?
The city is still responsible for injuries due to failure to maintain some sidewalks. If you have been injured on one of these sidewalks and you want to claim compensation, you will need to prove that your injuries were caused by a defect that the city was notified of in writing at least 15 days before the accident.
Luckily for injury victims, the Big Apple Pothole and Sidewalk Protection Committee has produced maps of sidewalk defects throughout the city that can be used in some cases to demonstrate that the city knew about a defect and should have repaired it.
