New York, NY - November 11, 2008 - David Perecman, New York personal injury and construction accident attorney, is speaking out on the enterprise corruption (racketeering) charges against Testwell Laboratories. According to Newsday.com, prosecutors have been investigating charges for months that Testwell falsified test results (to OSHA) for new construction projects said to be safe and sometimes billed companies for tests it never did. Recently a grand jury has returned a 10-count indictment against the company. The test results submitted to OSHA were about the quality and strength of concrete work done on new construction sites, increasing the chances for future accidents and putting public safety at risk.
"This entire investigation comes down to public safety. Poorly tested construction projects put all of those on site and in the surrounding area in jeopardy of being seriously injured or killed. By falsifying the test results of the strength of concrete, one day structures could collapse, creating a terrible and avoidable tragedy," said David Perecman, founder of The Perecman Firm, an experienced New York construction defect attorney. "OSHA puts policies in place to provide testing on construction projects to ensure both work site safety and the highest quality building. When companies cut corners, trying to save a few dollars or hurry along projects, is when people get hurt."
Some construction projects that are being questioned by the state of New York include Yankee stadium and the Freedom Towers in Manhattan. Due to the questionable testing, the city will be retesting the safety of these and over 100 other construction sites around New York City. The New York Times reported, "Prosecutors accused Testwell of cutting corners in evaluating the strength of concrete in various building projects." On numerous construction sites testers are supposed to put the different types of concrete being used through an eight-week safety analysis. Testwell, is being accused of skipping these crucial tests on the hundreds of occasions only relying on strength estimates created from a computer program.
