David H. Perecman, a Veteran New York Personal Injury Lawyer, Sues New York City for Wrong Imprisonment

The civil rights court case seeks restitution for unlawful jail time served in New York State.

May 2007 ---- David H. Perecman, a veteran personal injury lawyer from New York City and co-founder of the personal injury law firm of the Perecman Firm, filed a claim in April against New York City on behalf of a woman who spent unlawful jail time in New York State and was wrongly arrested and imprisoned at Riker's Island Penitentiary for four years.

Lourdes Torres, a simple 31-year-old immigrant from Mexico was coerced for hours into giving a confession to detectives regarding a murder that she did not commit. In January, almost four years after DNA evidence pointed to the presence of others at the murder scene and after defense attorney Edward Sapone took Ms. Torres' criminal case, the Queens' District Attorney dropped murder charges against her.

Mr. Sapone consulted with Mr. Perecman, a veteran personal injury lawyer in New York City, and recommended the court case to him for a civil suit.

In April, Mr. Perecman filed a civil action against New York City based on claims of wrongful imprisonment and failing to follow up on DNA and other evidence that exculpated Torres and possibly might have led to the real murderers. Mr. Perecman is asking for $20 million on behalf of his client who served unlawful jail time in New York State.

"This is an egregious case of a coerced confession and New York City detectives not following up on available evidence that could have shown that Torres was the wrong suspect," says Mr. Perecman. "Ms. Torres spent four years behind bars unjustly and now she is seeking justice for her cause."
